Vice Presidents of India List: Under article 63 of Indian Constitution, there shall be a Vice-President of India. The office of Vice President of India is the 2nd highest constitutional office in Indian government. Under Article 64 of Indian Constitution, the Vice-President shall be ex-officio Chairman of the Council of States and shall not hold any other office of profit. He is the ex officio chairman of the Rajya Sabha. Once elected, the Vice President Continues in the office for a term of 5 years but can continue in office until a successor assumes office irrespective of the expiry of term.
Under Article-64 and 89(1) of Indian Constitution Vice-President is ex-officio chairman of Rajya Sabha. Vice-President of India is the second most important authoritative body after the President. As per Indian Constitution Article 65, he is entitled to take important decisions in certain cases of contingency due to resignation, removal, death, impeachment or the inability of the president to discharge his/her functions. Eligibility for Vice President of India
- Candidate must be Citizen of India
- He must have completed the age of 35 years
- Qualified to be elected as Rajya Sabha member
- He must not hold any office of profit under the Union governemnet or any state Government or any local authority or public authority.
Powers and Functions of Vice Presidents of India
- The president of India is ex-officio chairman of Rajya Sabha, he Presides over meetings of the Rajya Sabha, his functions and powers are similar to that of speaker of Lok Sabha
- Vice-President acts as President when a vacancy occurs in the Office of the President due to his resignation, removal, death or otherwise for a period of maximum 6 months.
- While acting as President, the Vice-President draws salary, allowance, emoluments as that of President of India
- The election of a person as vice- president cannot be challenged on the ground that electoral college was incomplete.
- If the election of a person as Vice-President is declared void by the Supreme Court acts done by him before the date of such declaration of the Supreme court are not invalidated means they continues to remain in force
- Article 63 :- There shall be a Vice President of India
- Article 64:- The Vice- President shall be the Ex-Officio Chairman of the Council of States and shall not hold any office of profit.
- Article 65 :-The Vice-President to act as President or to discharge his functions during casual vacancy in the office or during the absence of President
- Article 66 :- The Vice-President shall be elected by the members of an electoral college of the members of the both Houses of parliament. The Vice- President shall not be member of either House of Parliament or of a House of the Legislative of any State.
- Article 67 :- the Vice-President shall not Hold office for a term of five years from the date of his appointment.
- Article 68 :- An election to fill a vacancy caused by the expiration of the term of office of Vice- President shall be completed before the expiration of the term. An election to fill a vacancy in the office of Vice President by reason of his death, resignation or removal shall be held as soon as possible after the occurrence of the vacancy.
- Article 69 :- Every Vice-President shall make an Oath or Affirmation on entering upon his office before the President shall be held as soon as possible.
